1. The petitioner is aggrieved by a file noting filed with the petitioner�s annexure A-5, which deals with validation of off-line admissions made by the petitioner school from classes Nursery to class VIII under the EWS/DG category before 23 March 2023. The noting communicates the comments of the District and the Private School Branch to the Directorate of Education (DoE), not recommending the petitioner�s case. Mr. Jha submits that the DoE is yet to take a decision in the matter.
2. This aspect has already been noted by this Court in its order dated 18 December 2023 whereby notice was issued in the present petition. It was observed that the inaction of the DoE to hear the petitioner and pass a formal order violated the directions contained in order dated 23 February 2023 passed by a co-ordinate Bench of this Court in WP(C) 2359/2023 (PVT Land Public Schools Trust v. Director Education).
3. Mr. Kartik Sharma, appearing for Mr. Santosh Kumar Tripathi, on instructions, submits that the DoE would grant an opportunity of hearing to the petitioner and pass a formal order on the petitioner�s request.
4. Accordingly, this petition is disposed of, with a direction to the DoE to hear the petitioner and pass a formal order on the petitioner�s request, positively within a period of two weeks from today. In case the petitioner continues to remain aggrieved by the decision taken, liberty would stand reserved with the petitioner to seek appropriate redress as available in law.
5. The petition is allowed to the aforesaid extent with no orders as to costs.
