1. This is a transfer petition by Vandana Rana, the wife of Manjeet Singh, seeking transfer of HMA case no.2191/2023, presently pending before the learned Principal Judge, Saket Courts to the learned Family Courts in Dwarka.
2. Learned counsel for the Petitioner submits that his client has been repeatedly threatened by the Respondent.
3. Though this may not be a ground which can justify transfer of the matter from Saket Courts to the learned Family Court of Dwarka, there are three other circumstances which justify transfer.
4. Firstly, this is a transfer application by the wife in a matrimonial dispute, and the wife is admittedly residing in Dwarka.
5. Secondly, the respondent is an employee of the Saket Courts and it would be in the interest of the principle that justice should not only be done but should be seen to be done that the matter is heard by another Court.
6. Thirdly, and perhaps most importantly, there is a petition, MC 48/2024 instituted by the petitioner against the respondent under the Protection of Women from Domestic Violence Act, 2015, pending before the Dwarka Courts.
7. For all these reasons, the prayer for transfer is allowed. HMA 2191/2023 (Manjeet Singh v. Vandana Rana) is transferred from the Saket Court to the Dwarka Courts
8. The Registry of the Saket Court is directed to take expeditious steps in order to ensure that the record of the case is transmitted to the Dwarka Courts so that it could be listed before the appropriate Judge.
9. The Transfer Petition stands allowed accordingly.
10. Let the matter be listed before the competent Judge in the Dwarka Courts on 4 April 2024.
