J U D G M E N T (oral)
1. Present petition has been filed by petitioner seeking following prayer:-
“i ) Intervene and issue a writ of habeas corpus and/ or any other appropriate writ , order or directions thereby the respondents to produce the detainee i. e. Maya Kumari to the petitioner being real elder brother of the detainee and deliver the custody of detainee to the petitioner.”
2. Issue notice. Learned Standing for the State accepts notice on behalf of the State. He has produced the status report dated 29.02.2024. The same is taken on record.
3. As per status report, efforts were made to trace out the missing girl and CDRs of suspect Sohan and missing girl Maya were obtained and analysed in which it was found that both were in contact with each other since October, 2023. Suspect Sohan Prajapati was thereafter interrogated. It is stated that he, initially, refused that he did not know any girl by the name of Maya and had never been in contact with her. He was thereafter confronted with CDR and then only he revealed that he was in relationship with the missing girl Maya and he along with Maya went to Jaunpur, Uttar Pradesh on 24.11.2023 where at about 500 meters away from his home, he had some arguments regarding marriage with Maya and then he killed her by strangulation and threw her body in a well.

As per status report, information in this regard was given to the concerned police officer of police station Gaura Badshapur, Jaunpur, UP who stated that one such body was found from the same well on 11 December, 2023. The staff of police station Gaura Badshapur, Jaunpur, UP came and interrogated the suspect and after interrogation, they took the suspect with them and case FIR No.38/2024 under Sections 302/201/506 IPC has been registered at PS Gaura Badshapur, Jaunpur, UP on the statement of Ram Milan (father of the deceased girl).
5. In view of the above, since the missing girl is no more and an FIR has been registered against the suspect, no further order is required to be passed in the present petition.
6. Petition is, accordingly, disposed of.
