SHAISTA ….. Petitioner

versus
JAMIA MILIA ISLAMIA UNIVERSITY ….. Respondent
Through: Mr. Pritish Sabharwal, Adv.
CORAM:
HON’BLE MR. JUSTICE C.HARI SHANKAR
O R D E R ( O R A L)
% 08.04.2024
1. This writ petition assails office order dated 21 November 2023 passed by the Department of Hindi in the Respondent University Jamia Milia Islamia University (JMI) whereby the admission of the petitioner to the MA Hindi Programme 2023-2024 was cancelled on the ground that she had failed to submit the marksheet of her qualifying examination which was BA (Hons.) in Hindi.
2. The BA (Hons). Hindi examination was also conducted by the JMI itself.
3. The JMI, in its counter-affidavit to the writ petition, has acknowledged that owning to a mis-communication, the BA (Hons.) marksheet could not be provided to the petitioner in time. The BA (Hons.) marksheet has now been provided to the petitioner.
4. The petitioner has also submitted the BA (Hons.) marksheet to the Department of Hindi, JMI.
5. In that view of the matter, the impugned office order dated 21 November 2023 is set aside.
6. The petitioner is reinstated as a student of MA Hindi for the 2023-2024 programme.
7. The petitioner shall, needless to say, have to undertake the examinations which she missed consequent to the cancellation of her admission to the MA Course. The JMI is directed to make appropriate arrangement in that regard. Mr. Sabharwal submits that the petitioner would be permitted to undertake the said papers as and when they are held in 2024-2025. The suggestion is acceptable to Mr. Umesh Kumar, learned counsel for the petitioner.
8. The writ petition stands disposed of in the aforesaid terms.
