versus
JAWAHARLAL NEHRU UNIVERSITY & ORS.
….. Respondents
Through: Mr. Vasanth Rajasekharan, Standing Counsel
CORAM:
HON’BLE MR. JUSTICE C. HARI SHANKAR
ORDER (ORAL)
% 06.05.2024
1. The prayer clause in this writ petition is for a direction to the Respondent 1 Jawaharlal Nehru University to award, to the petitioner, the degree certificate for Doctor in Philosophy in Computer Science and Technology, which he has undergone and cleared.
2. Mr. Manish Tiwari, learned Counsel for the petitioner, points out that, though the course in which the petitioner was enrolled was Ph. D in Computer Science and Technology, the degree that came to be awarded to him was for Doctor in Philosophy in Computer and System Sciences. This error, he submits, might probably have crept in because the department in which the course was being pursued was the Department of Computer and System Sciences. However, the course was of Doctor of Philosophy in Computer Science and Technology.
3. Mr. Vasanth Rajasekharan, learned Standing Counsel for JNU, acknowledges that this is a clerical error and submits, on instructions, that the University would correct the error and issue a fresh degree certificate to the petitioner. However, he seeks eight weeks time to do so as he submits that the degree certificate was issued as per the recommendations of the Academic Council of the JNU, which includes officials of the concerned Ministry who, at present, would not be readily available in view of the present 2024 General Elections. However, he undertakes that if eight weeks time is granted to the respondent, the needful would be done.
4. Mr. Tiwari, after some initial trepidation regarding the time sought by Mr. Vasanth Rajasekharan, agrees to his suggestion.
5. Accordingly, this writ petition is disposed of with a direction to the JNU to issue, to the petitioner, a fresh degree of certificate of Doctor of Philosophy in Computer Science and Technology, within a period of eight weeks from today.
6. The writ petition stands allowed in the aforesaid terms.
