1. The present petition has been filed by the petitioners for the following prayers:
In the light of the facts & circumstances enumerated above, it is humbly prayed that this Honorable Court, may, by issuing an appropriate writ, order or direction, be pleased to:
a. Direct the respondents to induct/appoint the petitioners as per their merits and preferences to the posts of Constable (GD) in Central Armed Police Forces (CAPFs), SSF, Rifleman (GD) in Assam Rifles and Sepoy in Narcotics Control Bureau, 2022 as advertised by the respondents in 2022 and allow them to join the training immediately; and
b. Direct the respondents to grant the petitioners all service benefits and seniority etc. from the date i.e. 28-08-2023 when the first appointments were made by the respondents; and
c. pass any other orders or directions as may be deemed fit and proper in the facts and circumstances of the case and in the interest of justice.
2. In substance, the prayer is for seeking induction /appointment of the petitioners as per their merits on the post of Constable (GD) in Central Armed Police Forces (CAPFs).
3. We have been informed by Mr. Abhishek Saket, SPCG appearing for the respondents, by filing a summarised chart (which is taken on record) of the result with respect to the ten petitioners, that nine petitioners are successful. The seven petitioners have been issued the appointment letters. The appointment letters to the remaining petitioners i.e. petitioner No.3 being Lakhan Sharma and petitioner No.8 being Karan Sarkar shall be issued subject to the completion of the formalities within four weeks, as an outer limit. The submission is taken on record.
4. In so far as the plea of the petitioners for grant of service benefits / seniority benefits with effect from August 28, 2023 is concerned the same is a premature plea. Liberty is with the petitioners to seek such remedy as available in accordance with law if any decision is taken to their prejudice.
5. The petition alongwith the pending application is disposed of.
