J U D G M E N T (oral)
1. Present petition has been filed seeking directions to the respondents to adjudicate the post-confirmation statutory petition dated 14.12.2022 preferred under Section 117(2) of the BSF Act, 1968 r/w Rule 167 of the BSF Rules, 1969 as well as petition dated 14.12.2022 preferred under Section 130 of the BSF Act for suspension of sentence in a time bound manner.
2. In view of the prayer sought, we hereby dispose of the present petition by giving direction to the respondents to adjudicate the said post-confirmation statutory petition dated 14.12.2022 within six weeks from today as per law and the decision taken thereon shall be communicated to the petitioner in writing within one week thereafter.
3. Needless to say that if the petitioner is still aggrieved by the decision of the respondents, he may challenge the same before the appropriate forum.
4. Learned counsel for the petitioner has raised another issue that as per Rule 129 of BSF Rules, respondents have not provided GSFC proceedings and he made representation dated 13.10.2022, however, till date, there is no action on the part of the respondents.
5. Accordingly, respondents are further directed to provide GSFC proceedings to the counsel appearing for the petitioner within two weeks from today.
6. In view of aforesaid directions, petition is disposed of.
