3.Inbrief, asper thecase of the petitioners, the marriage betweenpetitioner No.1 andrespondentNo.2 wassolemnizedaccordingtoHinduritesandceremonieson24.06.2007. Outof the wedlock, ababygirlwasbornon01.10.2014, who is incustodyof respondent no.2.
4.Proceedingsunder D.V. Act, 125Cr.P.C. were filedonbehalf ofrespondentno. 2andalsopresent FIRwas registeredon21.06.2023.
5.The matter isstatedtohave beenamicablyresolvedbetweenthe
partiesintermsof Memorandumof Settlementdated14.09.2023. Themarriage betweenthe partieshasalsobeendissolvedbymutualconsentunderSection13-B(2) of the HinduMarriageAct, videdecree dated15.12.2023.
Balance amountof Rs.1,00,000/-(One LakhOnly) hasbeenpaidtorespondentNo.2todaythroughDDNo. 343652datedDecember 16, 2023drawnonCanara Bank, Nangloi-II Branch, NewDelhiinfavour ofrespondent No.2 towards full and final settlement between the parties.
6.LearnedAPP for the State submitsthatinviewof amicable settlementarrivedbetweenthe parties, the State hasnoobjectionincase the FIR inquestion is quashed.
7.PetitionersaswellasrespondentNo.2are presentin-personintheCourttodayandhave beenidentifiedbyPSI PradeepKumar, PS AmanVihar. I have interactedwiththe partiesandtheyconfirmthatthe matter hasbeenamicablysettledbetweenthemwithoutanythreat, pressure orcoercion.
