J U D G M E N T (oral)
1. The present writ petition arises out of a letter dated 25.07.2023 which was converted to be treated as a habeas corpus petition by the Hon’ble PIL Committee vide order dated 17.08.2023. By way of the present petition the petitioner is seeking production of his minor daughter namely ‘M’ aged 17 years and her friend ‘J’ also aged 17 years who went missing from their house.
2. A status report dated 20.11.2023 has been handed over in Court today, same is taken on record. It is submitted in the status report that on 01.01.2023 complainant Mr. Bhagwandin S/o Minnu R/o H. NO. 383, Gali No. 10, First Floor Karkardooma Village, Delhi in his complaint, alleged that his daughter namely ‘M’ aged about 17 years alongwith her friend namely ‘J’ aged about 17 years are missing from their house and he suspected them to have been kidnapped by someone. During the course of investigation missing girl ‘J’ was traced and her custody was handed over to her parents and petitioner’s missing daughter ‘M’ was still untraceable.
3. It is also submitted that in continuation of the previous report, during the further course of enquiry following steps have been taken in search of missing girl ‘M’:
(i) On the basis of CDR analysis of Suspect Umesh Kumar @ Gagan, a team of PS Anand Vihar, Delhi visited to Indrapuram Makanpur, Ghaziabad UP but no clue was found regarding missing girl ‘M’.
(ii) Father of the missing girl ‘M’ namely Raju and other relatives were also contacted for any further information regarding missing girl ‘M’ but they have no clue.
(iii) Family of suspect namely Umesh Kumar @ Gagan and his relatives were also contacted for any further information regarding missing girl ‘M’ and the suspect but they had no clue.
(iv) That the NBW of suspect namely Umesh Kumar @ Gagan has been issued by the Ld. Metropolitan Magistrate vide order dated 12.09.2023 but the same returned non-executed.
(v) That the proceeding U/s 82 Cr.P.C has been initiated against the suspect namely Umesh Kumar @ Gagan vide order dated 05.10.2023.
(vi) The wireless message having description of the victim have been flashed to all SSPs/DCPs in India and all SHOs in Delhi but no clue was found so far.
(vii) Local enquiry was also conducted in the area regarding missing girl ‘M’ but no clue has been found yet.
(viii) That ZIPNET having data of Unidentified Dead Bodies and Unidentified Persons are being checked on regular basis to match the details of victim but found no clue so far.
(ix) Nearby police stations’ missing register and UIDB register were checked but no clue was found yet.
(x) During further course of investigation CDR through IMEI number of suspected person according to family members of victim was obtained and raid on different locations was also conducted on the basis of CDR analysis but no clue has been found yet.
(xi) That the help of the informers had been taken to obtain any valuable inputs to recover the missing girl ‘M’ but no clue has been found yet.

In view of the above, since various steps have been taken by the State to trace out the missing girl ‘M’, and an FIR bearing no. 01/2023 has already been registered at PS Anand Vihar and the investigation is in process, we hereby dispose of the present writ petition while directing the concerned police officials to file monthly status report before the concerned Ld. Metropolitan Magistrate and if any clue is found about the missing person, the same shall be transmitted to the petitioner.
5. In view of the above, the petition is disposed of.
