1. This petition has been filed by the petitioners under Sections 10 & 12 of the Contempt of Courts Act, 1971, seeking initiation of contempt proceedings against the respondents, who are alleged to have wilfully acted in defiance of the Order dated 09.09.2024 passed by this Court.
2. The petitioners have filed W.P.(C) No. 12560/2024 before this Court, challenging the Order dated 09.08.2024, whereby recoveries were directed to be made from the petitionersÂ’ salary on account of alleged overpayments made during the period 2015 to 2018. This Court by its Interim Order dated 09.09.2024 was pleased to stay the operation of the Impugned Order insofar as it pertains to the petitioners.
3. The petitioners complain that, despite of the order of stay, the respondents have continued to make recoveries from the salary payable to the petitioners.
4. Issue notice.
5. Notice is accepted by Mr.Syed Abdul Haseeb, the learned counsel appearing on behalf of the respondents. He tenders an unconditional/unqualified apology on behalf of the respondents for having made the recoveries in spite of the interim order of stay granted by this Court. He submits that this has occurred due to a communication gap between the various Authorities. He further submits that the amount recovered post the passing of the Interim Order dated 09.09.2024 shall be refunded to the petitioners within a period of two weeks from today.
6. In view of the above statement of the learned counsel for the respondents, and binding the respondents with the said statement, we accept the apology tendered by the respondents and dispose of the present petition.
