1. When this matter was called out, there is no appearance on behalf of the appellants.

2. The order dated 3 October 2023 passed by this Court indicates that the respondent expired a considerable period of time ago and that the appellants were granted an opportunity to substitute the respondent with his legal representatives by orders dated 29 July 2022, 15 September 2022, 4 January 2023 and 2 June 2023. The substitution never took place. A further opportunity was granted by the Court on 3 October 2023 for the appellants to substitute the deceased respondent by his legal representatives, subject to costs.

3. That opportunity has also been allowed to go abegging.

4. In these circumstances, the Court has no option but to dismiss the appeal as having abated.

5. The appeal is accordingly dismissed.
