3. In brief, as per the case of the petitioners, marriage between petitioner
and respondent No. 2 was solemnized according to Hindu rites and
ceremonies on 18.11.2010. Two male children were born out of the wedlock
who are presently in custody of respondent No.2. Due to temperamental
differences, respondent No.2 and petitioner started living separately. On
complaint of respondent No. 2 present FIR was registered on 31.10.2020.
3.Inbrief, asperthecase of the petitioners, marriagebetweenpetitionerandrespondentNo.2wassolemnizedaccordingtoHinduritesandceremonieson18.11.2010.Twomale childrenwere bornoutof the wedlockwhoarepresentlyincustodyofrespondentNo.2. Duetotemperamentaldifferences, respondentNo.2andpetitioner startedlivingseparately. Oncomplaintof respondent No. 2present FIR was registeredon 31.10.2020.
4.The disputesare statedtohave beenamicablysettledbetweenthe
partiesbefore CounsellingCell, FamilyCourt, WestDistrict, TisHazari
Court, Delhivide SettlementDeeddated28.11.2023.The marriage betweenpetitioner andrespondentNo. 2hasbeendissolvedbydecree of divorcedated08.02.2024bywayof mutualconsentunder Section13B(2) of theHindu Marriage Act, 1955.
5.Anamountof Rs.60,000/-hasbeenpaidtorespondentNo.2todaythroughBanker’sChequeNo.697862dated10.04.2024drawnonBankof
Baroda, NetajiSubhashPlace, Pitampura, DelhiBranchinfavour ofrespondent No.2towards full and final settlement between the parties.
6.LearnedAPP for the State submitsthatinviewof amicable settlementbetweentheparties, the State hasnoobjectionincase the FIRinquestionisquashed.
7.PetitioneraswellasrespondentNo. 2arepresentinpersonandhavebeenidentifiedbySITilakRaj, P.S.:Ranhola.I have interactedwiththe
partiesandtheyconfirmthatthe matter hasbeenamicablysettledbetweenthemwithoutanythreat, pressure or coercion. RespondentNo. 2alsostatesthatnothingremainstobe further adjudicateduponbetweenthe partiesandshe has no objection in case the FIR inquestionisquashed.

keeping the case pending. It would be nothing but an abuse of the process of
Court. Consequently, FIR No. 916/2020, under Sections 498A/34 IPC
registered at P.S.: Ranhola and the proceedings emanating therefrom stand
quashed.
