J U D G M E N T (oral)
1. It is noticed that in the present petition, the learned State Commission has also been impleaded as respondent No.1.
2. There is no requirement of impleading the Commission as one of the respondents herein and, therefore, the name of respondent No.1 is directed to be deleted from the array of the parties. Let amended memo of parties be filed during the course of the day.
3. The Petitioner-Ms. Murti Devi filed a complaint way back in the year 2013 seeking compensation for suffering agony on account of unwarranted rejection of her claim.
4. The claim was filed consequent upon the death of her husband.
5. The complaint was, eventually, allowed in her favour in the year 2021.
6. Such order has already attained finality.
7. Resultantly, the petitioner filed an execution (Execution Petition No. SC/7/EA/164/2021) which is pending adjudication and the sole request in the present matter is with respect to expeditious disposal of the same.
8. The last date before the learned State Commission was 26.03.2025 and the next date is 22.09.2025.
9. Learned counsel for judgment-debtor company i.e. M/s Bandhan Life Insurance Limited (respondent No.2 herein) appears on advance notice.
10. Learned counsel for petitioner submits that in view of the recent judgment given by the Honble Supreme Court in Periyammal (Dead) through Lrs and Others vs. V Rajamani and Another: 2025 SCC OnLine SC 507, even otherwise, such execution needs to be fast-tracked and has to be disposed of within six months.
11. After hearing arguments from both the sides, the present petition is disposed of with direction to petitioner to move appropriate application before the learned State Commission, seeking advancement/pre-ponement of date in the abovesaid Execution Petition with further request to expedite the disposal of the Execution Petition in terms of the abovesaid judgment.
12. Let such application be filed within a week from today. Learned State Commission is requested to consider the same in accordance with law.
13. Petition stands disposed of accordingly.
