O R D E R (O R A L)

1. The prayer clause in this writ petition reads thus:
“It is respectfully prayed that this Hon’ble Court may be pleased to:

A) Kindly allow the present Writ Petition

B) Kindly issue an appropriate Writ, order or directions especially in the nature of Mandamus thereby directing the Respondent no 1 and 2 to urgently decide the representation of the Petitioner dated 23.03.2024 for reducing the seats of the Petitioner in entry level class and for declaring Class I as the entry level Class of the Petitioner.

C) Kindly issue an appropriate Writ, order or directions especially in the nature of Prohibition thereby prohibiting the Respondent no 1 and 2 from allotting EWS category students to the Petitioner contrary to the declared strength submitted by the Petitioner in accordance with the circular dated 17.01.2024 issued by the Respondent no 1.

D) Pass and other orders or further orders, directions which this Hon’ble Court deems fit, necessary and expedient in the interest of justice.”
2. Mr. Utkarsh Singh, learned Counsel for the DoE, submits, on instructions, that the DoE would consider and take a decision on the petitioner’s request within three weeks and that the computerised draw of lots for allocating EWS/DG/CWSN students to entry level classes in schools would take place only thereafter.

3. Accordingly, the writ petition is disposed of, recording the statement of Mr. Utkarsh Singh.

4. The DoE is directed to take a decision on the petitioner’s representation and communicate it to the petitioner within three weeks from today.

5. This writ petition stands allowed to the aforesaid extent.
