1. This petition has been filed by the petitioner, aggrieved by his downgradation in the Central Seniority List prepared for Constable/(BS-TS) by the Border Security Force.
2. It is the case of the petitioner that in the Central Seniority List published on 27.09.2019 for the above post, the petitioner was placed at Serial No.30. In the subsequent Seniority List published on 28.08.2023, he was placed at Serial No.33, and in the latest Central Seniority List published on 09.09.2024, he has been further downgraded to Serial No.49. The petitioner states that although the petitioner has submitted representations seeking reasons for his downgradation, the same have not been responded to by the respondents.
3. Issue notice.
4. Notice is accepted by Mr.Syed Abdul Haseeb, the learned counsel for the respondents. He prays for time to seek instructions.
5. We are of the opinion that the respondents should communicate to the petitioner the reasons why he has been downgraded in the consecutive Seniority List(s) issued by the respondents.
6. Accordingly, we direct the respondents to treat the present petition as a representation of the petitioner and to communicate the reasons for his downgradation in the Seniority List to him, within a period of eight weeks from today. In case the petitioner is aggrieved by the reasons supplied by the respondents, it shall be open to the petitioner to challenge the same in accordance with law.
7. The petition is disposed of in the above terms.
