CM APPL. 3164/2024 (Exemption)
1. Allowed, subject to all just exceptions.
2. The application is disposed of.
W.P.(C) 714/2024
3. The petitioner in this writ petition is a student of Class IX in Prabhu Dayal Public School (Respondent 3). The only case that the petitioner has sought to set up is that though, earlier, his father was in a position to pay the fees of the school, owing to the intervention of the COVID-19 pandemic and other exigent circumstances, the financial position of his father has deteriorated to a point where he is not in a position to pay the school fees in the manner in which the school requires them to be paid. Mr. Pandey, learned Counsel for the petitioner submits on instructions that his clients father is willing to pay the school fees but in instalments.
4. Mr. Mohinder Singh, learned Counsel for the School submits on instructions that his client would be willing to accept the fees in instalments, provided that the offer is reasonable.
5. This petition is accordingly disposed of with liberty to the petitioner to approach the school for permission to pay the fees in instalments. In considering the request of the petitioner, the Court has no doubt that the school would adopt an approach which would factor in the financial circumstances in which the petitioner is placed and the fact that he is a student of Class IX.
6. The petition stands disposed of in the aforesaid terms.
CM APPL. 3165/2024 (Interim Relief)
7. This application does not survive for consideration and is disposed of.
