1. On 1 October 2019, the petitioners submitted an application to the Directorate General of Training (DGT), seeking permission for establishing a Multi Skill Training Institute (MSTI) in Northern Block, Bihar treating it as unserved block1. The petitioners sought affiliation for four units in the Electrician trade and four units in the Fitter trade from the academic session 2024-2024.
2. The DGT has, in its communication to the petitioners, stated that the processing of the petitioners’ application could be taken up only after NOC was obtained from the Directorate of Employment and Training, Bihar, impleaded as Respondent 2 herein. Ms. Banga, who appears for the DGT, submits on instructions that once a verification report from the Directorate of Employment and Training is received, the DGT would proceed to inspect the petitioners’ premises and process the petitioners’ application with all due expedition.
3. Despite issuance of notice and despite this matter being listed on several occasions, there is no response from Respondent 2.
4. The DGT has, on 9 January 2024, reminded the State Directorate, Bihar (Respondent 2) to intimate as to whether it was willing to issue an NOC for the petitioners so that a joint inspection of the petitioners institute could be undertaken thereafter.
5. In these circumstances, this writ petition is disposed of within the following terms:
(i) Respondent 2 is directed to positively convey a response to the email dated 9 January 2024 addressed by the DGT (Respondent 1) as to whether it has no objection to the grant of affiliation to the petitioners, for four units in the Electrician trade and four units for the Fitter trade from the academic session 2024-2025.
(ii) This decision will positively be taken within two weeks and communicated forthwith to the petitioners as well as to the DGT.
(iii) Immediately on receipt of the said communication, the DGT would proceed to process the petitioners’ application and take a decision thereon within two weeks thereof. The said decision would also be communicated to the petitioners as soon as it is taken.
(iv) Should any grievance continue to survive, the petitioners would be at liberty to seek remedies as are available in law.
(v) In case any further information or documents are required from the petitioners either by Respondent 1 or Respondent 2, they would immediately call upon the petitioners to provide the said information, which the petitioners would also provide as soon as it is sought.
