J U D G M E N T (ORAL)
1. The petitioner seeks following reliefs:
(i) To issue a writ, order, or direction in the nature of mandamus, directing Respondent take appropriate action in FIR No. 1210 dated 07.12.2023 lodged under section 420/467/468/120B/34 of IPC at P.S. Mangolpuri to conclude the investigation within shortest possible time;
(ii) Issue a writ, in terms of appropriate direction to prevent Respondents No. 2 to 10 from leaving the country or disposing further the mortgaged property i.e. a freehold built-up third floor with roof rights, located at House No. B-75 (Plot No. 75, Block B), measuring 140 sq.m in the layout of DDA Colony, New Jafrabad (West Gorakh Park Extension),Illaqa Shahdara, Delhi 110032 until investigations concludes; and/or
(iii) Pass any order or orders as this Honble Court may deem fit and proper in the facts and circumstances of this case.
2. So far as prayer clause (i) is concerned, the learned counsel for respondents on instructions of Investigating Officer/Inspr. Suneet Siddhu submits that out of six accused persons, two have been arrested and remaining are absconding, so efforts are being done to trace them out. On instructions of Investigating Officer, learned counsel for respondents assures that investigation would be concluded within shortest possible time, as sought by the petitioner.
3. So far as the prayer clause (ii) is concerned, learned counsel for petitioner does not press the same with liberty to approach the Civil Court for the relief to prevent further disposal of mortgaged property.
4. In the above circumstances as requested by both sides, the petition is disposed of granting liberty to the petitioner to approach Civil Court for appropriate remedy.
