CORAM:
HON’BLE MR. JUSTICE C. HARI SHANKAR
O R D E R (ORAL)
% 19.03.2024
1. The grievance of the petitioner in this writ petition was that the answer sheet of the petitioner for the Competition Law Examination, bearing paper code LB-4033 held in May/June 2023 and given by the petitioner as a student of Law CentreII, under the Faculty of Law, Delhi University, was not completely evaluated, as the examiner found the petitioners handwriting to be so poor that many of the words used by the petitioner were, according to the examiner, unintelligible.
2. Given the peculiar facts of this case, and as the Court was of the opinion that the answers written by the petitioner were not so unreadable as to justify their non-evaluation, the petitioner was permitted to provide typed transcripts of the answers. The examiner was requested to re-evaluate the paper on the basis of typed transcripts. Liberty was reserved with the examiner to satisfy himself that the typed transcripts corresponded to the handwritten answers.
3. That exercise has, happily, been completed. The petitioners paper has been re-evaluated on the basis of the typed transcripts provided by the petitioner. The answer sheet was handed over by the University to the Court in a sealed cover. The sealed cover has been opened, seen, resealed, and returned to learned Counsel for the University.
4. The University is directed to release the petitioners result to the petitioner within a period of two weeks from today.
5. The Court expresses its gratitude to the examiner, who has had to re-examine the same paper twice over, and has done so without demur or hesitation.
6. The petition stands disposed of in the aforesaid terms.
