the petitioner No.1 Deepak Bhatla which was impounded at the
time of granting bail.

2.Inbrief, asperthecase of the petitioners, marriagebetweenpetitionerNo. 1andrespondentNo. 2wassolemnizedaccordingtoHinduritesandceremonies on08.02.2015. Amalechildwas born out of the wedlock, whoispresentlyincustodyof respondentNo. 2. Due totemperamentaldifferences,
petitionerNo. 1andrespondentNo. 2startedlivingseparately. Oncomplaintof respondent No. 2, presentFIR was registered on25.05.2017.
3.The disputeshavebeenamicablyresolvedbetweenthe partiesvidesettlementdeeddated24.11.2021. The marriagebetweenpetitioner No. 1andrespondentNo. 2hasbeendissolvedbydecree of divorce bywayofmutualconsentunder Section13B(2) of the HinduMarriage Actvidejudgment dated09.05.2023.
4.Balance amountof Rs. 1,50,000/-hasbeenpaidtorespondentNo. 2todaythroughDDNo.737741dated11.03.2024drawnonIDFC FirstBank,
CrossingRepublic, GhaziabadBranchinfavour of respondentNo. 2,
towards full and final settlement betweenthe parties.
5.LearnedAPP fortheState oninstructionsof IOsubmitsthatstatusreporthasbeenfiledonrecordandinviewof amicablesettlementbetweenthe parties, the Statehasnoobjectionincase theFIR inquestionisquashed.
She further submitsthatsince the accusedhadsurrenderedpursuanttoproceedingsunder Section82Cr.P.C. LOC shallbewithdrawn, whichwasinitiated on account of initial failure of petitioner No. 1to join investigation.

been identified by SI Jhabar Mal, PS: Mohan Garden. I have interacted with
the parties and they confirm that the matter has been amicably settled
between them without any threat, pressure or coercion. Respondent No. 2
also states that nothing remains to be further adjudicated upon between the
parties and she has no objection in case the FIR in question is quashed.

RespondentNo. 2alsostatesthatnothingremainstobe further adjudicateduponbetweentheparties andshe has no objectionin case the FIR in question isquashed.
7.Consideringthe factsandcircumstances,since the matter hasbeenamicablysettledbetweenthe parties, nousefulpurpose shallbeservedbykeepingthecase pending. Itwouldbe nothingbutanabuseoftheprocessof
Court. Consequently, FIR No. 0276/2017, under Sections498A/406/34IPC,
registered at PS:Dabriandproceedings emanating therefrom standquashed.
Further, inviewof statementoflearnedAPP oninstructionsof IO, the
LOC againstpetitioner No. 1shallbe withdrawn. LearnedTrialCourtisalsodirectedtorelease the passportof petitioner No. 1, incase itisnotrequiredtobe retained for any other purpose.
8.Inthe factsandcircumstances, insteadof imposingthecosts,
petitioners are directedto plant50 saplingsof trees, whichare upto 03feet inheightinthe localparksinthe residentialarea withinjurisdictionof PS:
Dabri, Delhiafter gettingintouchwiththe competentauthority(i.e.
Horticulture Departmentof MCD/DDA/Conservator of Forests,
Departmentof Forests& Wildlife, Govt.of NCTof Delhi) throughIO/
SHO, PS: Dabri. The photographsof planted saplings alongwith reportof IO/SHOconcernedshallbe forwardedtothisCourtwithineightweeks.
Further, the upkeepof the saplings/treesshallbe undertakenbytheauthoritiesconcerned. Incase ofnoncomplianceof directionsfor plantingof
trees, the petitionersshallbe liable todepositcostof Rs. 50,000/-withthe
DelhiState Legal Services Authority.
