2. This is an application filed by the Plaintiff seeking leave to file additional documents under the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015 (hereinafter, Commercial Courts Act). The Plaintiff, if it wishes to file additional documents at a later stage, shall do so strictly as per the provisions of the Commercial Courts Act and the DHC (Original Side) Rules, 2018.

4. This is an application seeking exemption from filing originals/certified/cleared/typed or translated copies of documents, proper margins, electronic documents, etc. Original documents shall be produced/filed at the time of Admission/Denial, if sought, strictly as per the provisions of the Commercial Courts Act and the DHC (Original Side) Rules, 2018.
5. Exemption is allowed, subject to all just exceptions. Accordingly, application is disposed of.
I.A. 25027 /2023 (u/S 12A of the Commercial Courts Act)
6. This is an application filed by the Plaintiff seeking exemption instituting pre-litigation mediation under Section 12A of the Commercial Courts Act.
7. Considering the averments in the application and the products being cosmetics, the Court is satisfied that in terms of the judgment of the Supreme Court in Yamini Manohar v. T.K.D Keerthi, (2023 LiveLaw (SC) 906), that the present suit contemplates urgent interim relief.
8. Accordingly, the exemption is allowed and application is disposed of.

9. This is an application seeking extension of time for filing court fee. The court fee be deposited within a week. Let the challan be placed on record. Application is disposed of.

10. This is an application filed by the Plaintiff under Order 11 Rule 1, 3 and 5 of the CPC seeking discovery, production and inspection of the Defendants documents in terms of paragraph 7 of the application.
11. Issue notice in this application. Let the reply to this application be filed within 6 weeks, and rejoinder, thereafter, within 4 weeks.

12. Let the plaint be registered as a suit.
13. Issue summons to the Defendants through all modes upon filing of Process Fee.
14. The summons to the Defendants shall indicate that the written statement to the plaint shall be positively filed within 30 days from date of receipt of summons. Along with the written statement, the Defendants shall also file an affidavit of admission/denial of the documents of the Plaintiff, without which the written statement shall not be taken on record.
15. Liberty is given to the Plaintiff to file the replication within 15 days of the receipt of the written statement(s). Along with the replication, if any, filed by the Plaintiff, an affidavit of admission/denial of documents of the Defendants, be filed by the Plaintiff, without which the replication shall not be taken on record. 18. Issue notice.
19. Just looking like a wow! – This expression has recently become a sensation in the social media.
20. However, the present suit relates to the trade mark WOW used by the Plaintiff in respect of toiletries and other products, including personal care products since 2014.
21. The Plaintiffs case is that it uses the brand WOW for a large variety of products, including supplements, herbal blends, creams, serums, lotions, shampoos, bath & body products, essential oils, etc. The said mark is adopted in a distinctive logo form by the Plaintiff, and is extracted below:
22. The Plaintiff operates a website at www.buywow.in and has also registered various other websites to promote its products. It also has a substantial presence on social media. The products of the Plaintiff are sold in extremely distinctive containers, featuring a unique trade dress and colour combination of dark brown, white and gold.
23. The Plaintiffs sales in the years 2022-23 exceeded Rs. 258 crores, which, according to the Plaintiff, establishes its goodwill in the business for the WOW brand. The Plaintiffs products are stated to be endorsed by various celebrities, including Mr. Kartik Aaryan, Ms. Rashmika Mandanna, Ms. Disha Patani, Ms. Bhumi Pednekar, and Ms. Kareena Kapoor Khan. The advertising expenses of the Plaintiff are stated to be substantial.
24. The Plaintiff asserts rights in the trade mark WOW, the writing style of the said mark, and the trade dress. In addition, the Plaintiff also claims design registration in respect of the Plaintiffs shampoo product.
25. The mark WOW bearing no. 3075612 dated 9th October, 2015 has been registered as a device mark, since 2015. The said device mark has been registered in respect of various classes, including classes 5, 35, 16. A complete list of the Plaintiffs WOW marks have been set out at paragraph 22 of the plaint.
26. As per the plaint, labels of the Plaintiffs shampoo products have also been registered. The said registrations in respect of the Plaintiffs label for its shampoo bottles are as follows:
27. The plaint avers that the Plaintiff has successfully protected its products and trade dress from infringement by initiating legal proceedings. In one such proceeding filed before the High Court of Karnataka, the Plaintiff has been able to obtain a protective order, wherein W.P. No. 5925 of 2023 the Court granted interim relief, restraining the Defendant from using the mark ‘WOW SKIN COSMO’ or any other mark identical or similar to ‘WOW SKIN SCIENCE’, and/or the trade dress and/or registered design of Body Cupid.

29. In the present suit, the Defendants are as follows:
* Defendant No. 1 is M/s. VBRO Skincare Limited.
* Defendant Nos. 2 and 3 are Mr. Dhorajiya Bipinbhai Dharamshibhai, the proprietor of M/s. VBRO Skincare Pvt. Ltd., and Mr. Vimalbhai Kamleshbhai Dhorajiya, proprietor of an entity named Vkeshbund Pvt., respectively.
* Defendant No. 4 is M/s Herbocare Herbal Products, which is believed to be the manufacturer of the alleged infringing products.
* Defendant Nos. 5 to 7 are respectively, Amazon Seller Services Private Limited, Flipkart Internet Pvt. Ltd., and Acevector Limited (Snapdeal).
30. The plaint avers that the Plaintiff discovered listings for hair care products under the marks ‘VBRO’ and ‘WQVV’ on various e-commerce platforms, particularly on those of Defendant Nos. 5 to 7. These ‘WQVV’ products were found to infringe the Plaintiff’s trade mark rights in the ‘WOW’ mark, and their trade dress also seemed imitative of the Plaintiffs WOW range of products.
31. The grievance in the present case is that the Defendants, who sell identical products under the mark VBRO and WQVV have actually copied and imitated the entire trade dress, get up, lay out, colour combination, writing style of the Plaintiffs WOW products.
32. Comparative images of the Plaintiffs and the Defendants products are set out below revealing that there is almost an uncanny identity between the Plaintiffs and the Defendants get up, writing style and colour combination:

33. Ld. counsel- Mr. Dhruv Anand along with Ms. Udita Patro submits that the Defendants are also infringing the registered design no. 318745 dated 14th June, 2019, which is a unique design used by the Plaintiff for its shampoo products.
34. The Court has perused the physical products which have been handed across. Insofar as the trade dress, get up and colour combination is concerned, the case is one of res ipsa loquitur, where the imitation is writ large. The containers and the products sold by the Defendants are almost complete imitations of the Plaintiffs products.
35. In addition, the manner in which WQVV is depicted could easily confuse any consumer into believing that the impugned products manufactured by Defendant Nos. 1-4 is a WOW product, especially, with the elongated W in the third letter. The writing style and various descriptors on the containers are also identical. Even the products manufactured and sold under the mark VBRO have an identical trade dress.
36. Under these circumstances, the Court has no doubt that the Defendants products could be passed off as those of the Plaintiff. The Defendants products are available on various e-commerce platforms such as Amazon, Flipkart and SnapDeal. The listings have been perused by the Court. Accordingly, the Plaintiff has made out a, prima facie, case for grant of an injunction. Balance of convenience lies in favour of the Plaintiff, and irreparable harm would be caused, if an injunction is not granted.
37. Mr. Sai Krishna, ld. Counsel who is present in Court is requested to accept notice on behalf of Amazon Sellers Services Pvt. Ltd.
38. Accordingly, Defendant Nos. 1 to 4 are accordingly restrained from using the marks WQVV or any other mark that is identical or deceptively similar to the Plaintiffs trade mark WOW, including the device and logo form of the WOW marks, for the manufacture and sale of products. However, the present order is not an embargo on the said Defendants from using the word WOW in a descriptive sense to connote surprise or exclamation.
39. In addition, the Defendants Nos. 1 to 4 are also restrained from manufacturing, selling, offering for sale any personal care, household products, cosmetic and household products in a trade dress, colour combination, get up, lay out, arrangement or in containers that substantially imitate the Plaintiffs trade dress, containers and products.
40. Defendant Nos. 5 to 7, which are e-commerce platforms, are directed to take down the listings as set out in Document 1 to the plaint, also annexed to the present order as Annexure A. These platforms shall comply and take down the said listings specified in Annexure A within 72 hours upon receiving a copy of this order.
41. List before the Joint Registrar on 5th February, 2024.
42. List before the Court on 10th May, 2024.
43. Compliance of Order XXXIX Rule 3 CPC within a week.
44. Injunction order shall be issued subject to proof of deposit of court fee.
