This petition has been filed by the petitioners praying for a direction to the respondents to consider the petitioners for promotion to the rank of Commandant (GD) for the vacancy in the year 2025 alongwith their juniors whose nominations are called vide notice No.11/08/2024/SSB/Pers-1 2469-71 dated 05.09.2024.
3. It is the case of the petitioners that the petitioners have completed over three years of service in their present ranks as Second-in-Command (GD) with the respondent no.1, and as per the relevant Recruitment Rules, being Sashastra Seema Bal Group ‘A’ Combatised (General Duty), Director General, Additional Director General, Inspector General, Deputy Inspector General and Commandant Posts Recruitment Rules, 2013, they are entitled to be considered for promotion to the next rank of Commandant (GD) as their juniors, who have completed their qualifying/eligibility service, are being considered for promotion.
4. Issue notice.
5. Notice is accepted by Mr.Farman Ali, the learned counsel on behalf of the respondents.
6. Considering the nature of the grievances raised by the petitioners, we are of the opinion that the respondents must consider the present petition as the representation of the petitioners and decide on the same within a period of four weeks from today, communicating their decision to the petitioners. In case the petitioners are aggrieved of the decision taken by the respondents, it shall be open to the petitioners to challenge the same in accordance with the law.
7. The petition is disposed of in the above terms.
