1. The prayer in this writ petition is only for a direction to the Directorate of Education/GNCTD to handover the management of the Alok Punj Secondary School, Karawal Nagar to the petitioner as per the order dated 21 April 2010 passed by the Honble Lieutenant Governor (LG) of Delhi, which remains unchallenged.
2. It appears that there was considerable litigation regarding the identity of the society who was entitled to run the school. The order of the Honble LG directs the DOE to take steps to handover the management of the school to the petitioner after ensuring that the petitioner was a properly and legally constituted society and after verifying the bonafides of its members.
3. In the counter affidavit filed by way of response to this writ petition, one of the grounds taken for delay in compliance with the order of the Honble LG was that the exact identity of the Society, which was competent to administer the school, was still disputed.
4. However, today, Mr. Vashisht, learned Counsel appearing for the DOE submits that the litigations have drawn to a close and that, today, the only legitimate society who can lay claim to the school, is the petitioner.
5. However, Mr. Vashisht requests that the DOE may be granted time till the conclusion of the Board examinations which are to take place in the first half of this year so that there is no disruption in the studies of the students.
6. Mr. Dhananjay Rana, learned Counsel for the petitioner, is agreeable to the suggestion.
7. Mr. Vashisht also submits that as per the report received by the DOE, building of the school is probably in a dilapidated condition and may be hazardous. Mr. Rana undertakes to carry out the necessary renovations/repairs to ensure that the building is fit to be run as a school.
8. Subject to the said repairs and renovations being carried out, the respondent is directed to comply with the order dated 21 April 2010 of the Honble LG and handover the management of the school to the petitioner within a period of four weeks of conclusion of the Board examinations.
9. The petition stands disposed of in the aforesaid terms.
