2. This petition has been filed by the petitioner challenging the Rejection Slip dated 19.10.2024, whereby the petitioner was declared as disqualified in the Physical Standard Test (in short, ‘PST’) for Height in the selection process for the post of Sub-Inspector in Delhi Police, Central Armed Police Forces (CAPFs), SSF, and Rifleman (GD) in Assam Rifles – 2024, as advertised by the Staff Selection Commission (in short, ‘SSC’) the respondents.
3. It is the case of the petitioner that the petitioner had duly qualified the height requirement in the previous years’ SSC Sub-Inspector PST, as evidenced by the PET/PST result dated 17.11.2023, which records his height as 170 cm, meeting the standard required for the examination in question.
4. Issue notice.
5. Notice is accepted by Mr.Mohan Shyam, learned counsel for the respondents. He submits that he does not have the instruction. He further submits that the representation of the petitioner is under consideration by the respondents.
6. Having considered the submissions made, we are of the opinion that the dispute involved in the present petition is very limited, being only on the height of the petitioner. Keeping in view the fact that any delay in adjudication of the present petition may have serious consequences in terms of the seniority and other service conditions and specially keeping in view the Medical Certificate dated 17.11.2023 that has been relied upon by the petitioner, we are of the opinion that the petitioner’s height shall again be measured by the competent authority.
7. Accordingly, we dispose of the present petition by directing the respondents to have the petitioner’s height re-measured at Safdarjung Hospital, New Delhi, on 18.11.2024.
8. The petitioner shall present himself at the Office of the Medical Superintendent, Safdarjung Hospital, on 18.11.2024 at 11.00 A.M. The report of the measurement shall be final and not subject to challenge by either of the party. A representative of the respondents shall also remain present during the measurement.
9. In case the petitioner meets the height standard as prescribed in the advertisement in question, the respondents shall permit the petitioner to participate in the remaining steps of selection for seeking appointment under the advertisement in the question.
10. The petition along with the pending application is disposed of with the above directions.
11. A copy of this order be given dasti under the signature of the Court Master.
