1. The present Contempt Petition under Section 12 of the Contempt of Courts Act, 1971 has been filed on behalf of the petitioner for the wilful disobedience of the Order dated 01.08.2023 on the part of the Contemnor/respondent.
2. It is asserted that the passport of Master Rudra would be renewed only after two Orders dated 21.02.2023 and 29.05.2023 passed by this Court. After the renewal of the passport, there was a need for renewal of Indian VISA to facilitate the stay of the child, Master Rudra in India who is a citizen of Mexico. The documents, namely, passport, Aadhar Card and NOC were required from the respondent/father, for which the respondent/father was directed to provide to the petitioner vide Order dated 01.08.2023. It is claimed that though scanned copy of the Aadhar Card was sent but it was deliberately mutilated as the last two digits of the Aadhar Card as well as the QR Code printed on it was redacted.
3. It is claimed that the actions of the respondent amount to contempt as his endeavour is only to harass the petitioner.
4. It is further stated that the NOC has been provided to the petitioner subsequently vide E-mail dated 16.08.2023 for the purpose of renewal of VISA which has now been renewed. However, the self-attested copy of the Aadhar Card as well as the passport of the respondent/Contemnor is required for the registration of the child, Master Rurda for Class Xth CBSE Board Examination and despite the directions, the respondent/Contemnor has failed to comply with and is guilty of Contempt of Court.
5. The respondent who is present in the Court has submitted that he has already provided the NOC on the basis of which the VISA of the child already stands renewed. He further submits that he has sent the aforesaid incomplete Aadhar Card due to security purposes. Insofar as providing his Aadhar Card to the school Authority is concerned, it is stated that he has not been permitted to meet the child for the last five years. The respondent further submits viz-a-viz., the registration that he is ready to submit the requisite documents for the registration of son, Master Rudra in Class Xth Board’s Examination directly to the school authority.
6. In view of above, the respondent is directed to seek an appointment of the Principal of the school where the son of the parties studies within one week and after getting the appointment, he shall submit all the requisite documents that are required for registration to the school Authority directly.
7. Accordingly, the present Contempt Petition is disposed of in above terms.
