W.P.(C) 626/2024
1. This petition has been filed by the petitioners with the following prayers:-
“In the light of the facts & circumstances enumerated above, it is humbly prayed that this Hon’ble Court may, by issuing an appropriate writ, order or direction, kindly be pleased to:
a. quash the decision dated 21.11.2023 of the respondents to keep the results of the petitioners on hold and to keep the candidature of the petitioners subject to verification of identity from CFPB/CFSL; and
b. direct the respondents to declare the results of the petitioners and issue the appointment/joining letters to the petitioners for the post of Constable in their respective trades in SSB issued vide a detailed combined advertisement dated 28.07.2020 without any further delay; and
c. pass any other orders or directions as may be deemed fit and proper in the facts and circumstances of the case and in the interest of justice.”
2. In effect, the case of the petitioners is that, they applied for the post of Constable (Driver, Cook, Water Carrier and Barber) in Sashastra Seema Bal (SSB) – 2020 in terms of the advertisement issued by the respondents on July 28, 2020. It is their case that even after successfully qualifying all the stages of the examination and despite the inclusion of their names in the Merit / Select List, their result has been kept on hold subject to verification of their identity from CFPB / CFSL, while other candidates have been given the appointment / joining letters. In substance, the petitioners are seeking direction to the respondents that they be given appointment letters, so that they can join their duties on the post, they have applied for.
3. On the other hand, learned counsel for the respondents, who appears on advance notice would submit that there are around 138 candidates, whose result has not been declared as a decision has been taken by the Competent Authority to constitute a Board for verification of their identity as to whether they had actually appeared in the examination. She submits, as per her instructions, period of 2 to 3 months shall be taken by the Board to come to a final conclusion.
4. Noting the aforesaid submission made by learned counsel for the respondents, we are of the view that this petition must be closed at this stage. It is ordered accordingly.
5. It goes without saying, action shall be taken by the respondents based on the findings of the Board.
CM APPL. 2745/2024
Dismissed as infructuous.
