versus

NATIONAL COUNCIL FOR TEACHER EDUCATION & ANR. ….. Respondents
Through: Mr. Rahul Madan, SC for NCTE

CORAM:
HON’BLE MR. JUSTICE C. HARI SHANKAR

O R D E R (O R A L)

1. One of the contentions advanced by Mr. Dhananjay Mishra, learned Counsel for the petitioner, is that an appeal preferred by the petitioner under Section 18 of the National Council for Teachers Education (NCTE) Act, on 22 July 2023, seeking approval of restoration of the recognition of the petitioner for running the B. Ed. course with an intake of 100 students in view of the additional faculty which has been recruited by it, is pending before the Appellate Committee in the NCTE.

2. For the present, therefore, I deem it appropriate to dispose of this writ petition with a direction to the Appellate Committee to take a decision on the said appeal preferred by the petitioner within one week from today and to communicate the decision to the petitioner within three days of its being taken.

3. Needless to say, the rights and remedies of the petitioner, in case it continues to remain aggrieved by the said decision, would remain reserved.

4. The petitioner is permitted to submit its latest faculty list to the appellate committee within two days from today. If so submitted, the said faculty list would also be taken into consideration by the Appellate Committee.
